Green Day Exchange
Parties to the Agreement
This agreement is concluded between the cryptocurrency exchange internet service, hereinafter referred to as the Service Provider, on one hand, and the Client, represented by the person using the Service Provider's services, on the other hand.
Glossary of Terms
2.1. Cryptocurrency exchange — an automated internet service product provided by the Service Provider on the basis of these rules.
2.2. Client — a natural person who agrees to the conditions of the Service Provider and this agreement.
2.3. Cryptocurrency — a digital asset used as a medium of exchange in decentralized blockchain networks, accounted for in accordance with the rules of the respective blockchain network.
2.4. Application — information submitted by the Client electronically to use the Service Provider's resources, confirming acceptance of the service terms offered by the Service Provider.
Transaction Terms
These rules are established on the basis of a public offer, which is formed when the Client submits an application and constitutes one of the main components of this agreement.
A public offer refers to the terms and conditions of the application as published by the Service Provider. The main component of the public offer is the action taken by the Client when submitting an application, indicating their precise intention to enter into an agreement on the terms offered by the Service Provider.
The time, date, and parameters of the application are generated automatically at the moment the application is completed. The offer must be accepted by the Client within 3 hours of the application being completed.
The service agreement takes effect from the moment the full amount of cryptocurrency specified in the application is received from the Client to the Service Provider's wallet address.
Cryptocurrency operations are recorded in accordance with the rules, regulations, and format of the respective blockchain networks.
Subject of the Transaction
Using technical methods, the Service Provider undertakes to exchange cryptocurrencies for a commission fee from the Client, upon submission of an application.
The Service Provider undertakes to transfer funds to the wallet address specified by the Client. Any profit arising from the exchange remains with the Service Provider as additional revenue and commission for services rendered.
Supplementary Terms
5.1. If the amount received by the Service Provider differs from that specified in the application, the Service Provider recalculates accordingly. If the difference exceeds 10%, the Service Provider terminates the agreement unilaterally and returns all funds minus transfer fees.
5.2. If the cryptocurrency is not sent by the Service Provider to the Client's specified address within 24 hours, the Client has the right to demand termination and a full refund. The refund is processed within 24 hours of receiving the request.
5.3. If funds are not received from the Client within the specified timeframe, the agreement is terminated unilaterally by the Service Provider. Funds received after the deadline are returned minus transfer fees.
5.4. If a transfer delay occurs due to the blockchain network, the Service Provider is not liable for any resulting damages. The Client agrees that all claims shall be directed to the payment system.
5.5. If tampering with communication flows or attempts to interfere with the service's code are detected, the application is suspended and funds are subject to recalculation. If the Client disagrees, they may terminate the agreement and receive a refund.
5.6. By using the Service Provider's services, the Client fully agrees that the Service Provider bears limited liability within the scope of these rules and provides no additional guarantees.
5.7. The Client undertakes to comply with applicable laws, not to tamper with communication flows, and not to interfere with the normal operation of the service.
5.8. The Service Provider is not liable for losses due to erroneous transfers if the Client provided incorrect wallet addresses.
5.9. In case of blockchain network failures, such applications are processed manually during business hours.
Warranty Period
Within 24 hours of completing the cryptocurrency exchange, the Service Provider guarantees the provision of services unless otherwise specified.
Force Majeure
If unforeseen circumstances arise during the processing of an application that prevent the fulfillment of the agreement, the execution deadline is extended for the duration of the force majeure event.
The Service Provider is not liable for delayed obligations. In case of a technical failure during the exchange, the user must contact support for a refund.
Form of the Agreement
This agreement is accepted by both parties, the Service Provider and the Client, as legally equivalent to a written contract.
Privacy Policy
9.1. The Client confirms consent for the Service Provider to process personal information to fulfill the terms of this Contract and conduct mutual settlements. Deletion of personal information is carried out upon written request.
9.2. We only ask for the minimum information necessary for the exchange: wallet address, email, and optionally Telegram for communication. We reserve the right to request additional information if necessary.
9.3. Cookies are used to save user preferences: language and theme settings.
9.4. Our servers automatically record certain information: web requests, IP address, browser type and language, date and time of request.
9.5. We take all necessary measures to protect data from unauthorized access, modification, disclosure, or destruction, including appropriate encryption.
9.6. We make every effort to provide you with access to your personal data and/or delete it upon your request.
Identity Verification
Identity verification is not required for standard cryptocurrency exchange operations.
However, in cases of suspected fraud, money laundering, or AML screening flags, the Service Provider reserves the right to request identity verification documents from the Client. The Client agrees to undergo the verification procedure upon the Service Provider's request in such cases.
Claims and Disputes
Claims under this agreement are accepted by the Service Provider via email or Telegram, in which the Client states the nature of the claim.
Exchange Operations
12.1. It is strictly prohibited to use the Service Provider's services for illegal transfers and fraudulent activities. The Client undertakes to comply and bears criminal liability in case of fraud.
12.2. If an application cannot be fulfilled within 60 minutes during business hours due to independent circumstances, funds will be credited to the Client's account within 24 hours. In exceptional cases, this period may be extended.
12.3. Upon request, the Service Provider has the right to provide transaction information to law enforcement and victims of proven fraud.
12.4. The Client undertakes not to interfere with the Service Provider's operations and to provide accurate information.
12.5. It is strictly prohibited to use the service for arbitrage purposes. If arbitrage is suspected, the exchange application is cancelled with a refund.
12.6. By accepting the offer, the Client undertakes to follow all instructions on the website and familiarize themselves with the operating procedures.
12.7. All incoming cryptocurrency undergoes AML screening. The final exchange decision is made by the security team. In case of rejection, funds are returned in full.
12.8. The sender and recipient of an application must be the same person. Transfers to third parties are prohibited.
12.9. The Service reserves the right to engage third-party providers to fulfill its obligations.
12.10. If a refund is required, the Service returns assets at the current rate, withholding a 4% commission (crypto exchange fees) or 1% for stablecoin payments.
Refund Policy
13.1. The Service Provider has the right to refuse service and issue a refund under the following circumstances: the source of funds violates AML requirements; funds were sent from addresses not belonging to the Client; payment was initiated by a third party without authorization.
13.2. The Service Provider may suspend an application pending identification if the Client has not provided requested documents upon an AML flag.
13.3. If an application cannot be fulfilled within the established timeframe, the Service Provider returns funds to the same account.
13.4. The Client has the right to request a refund before the application is fulfilled. Refunds are processed within 24 hours, minus network fees.
13.5. An application is considered fulfilled from the moment funds are sent to the Client's address. No refunds are provided after fulfillment.
13.6. Unilateral actions aimed at forcing a refund without prior notification and agreement are considered a violation of service terms.
Taxation
It is your responsibility to determine what taxes, if any, apply to your transactions, and it is your obligation to report and remit the correct tax to the appropriate tax authority.
We are not responsible for determining which taxes apply to your transaction. You agree to comply with all applicable tax laws in connection with your use of Green Day Exchange services.
Account Restrictions
We reserve the right to restrict access to the site or refuse service for the following reasons:
• Violation of any terms of this Agreement • Providing false information • Use of illegally obtained funds • Using anonymous agents or VPN • Spam or creating multiple accounts per person
Disclaimer
The Service Provider has the right to refuse to enter into an agreement and to fulfill an application without providing reasons (based on service rules). This clause applies to any client.
